Usually, once you've skipped multiple payments, sometimes three or four, a lender would not initiate the foreclosure phase. That gives you time, instead of foreclosure, to pursue some alternative steps, such as loan forbearance, a short sale, or a deed. How Filing Can Help You:

The court automatically issues an order (called the order for relief) when you file either a Chapter 13 or Chapter 7 bankruptcy, which involves a great thing known as the "automatic stay." The automatic stay orders the creditors to immediately cease their collection activities.


If your lender has arranged a foreclosure sale of your home and you apply for Chapter 7 bankruptcy, the sale will be legally delayed, usually for three or four months, as the bankruptcy is pending. The lender may, however, seek permission from the bankruptcy court to proceed with the sale by filing a "motion to lift the automatic stay." If successful, you will not get the full three to four months.


But, even then, it takes time for the motion to be filed and heard, so the sale will usually be delayed by bankruptcy for at least two months, or even longer if the lender is late to seek the motion to remove the automatic stay.
